 exercise of powers conferred by section 30 of the Registration of Births and Deaths Act, 1969(18 of 1969), the State Government with the approval of the Central Government hereby makes the following rules to amend the Registration of Births and Deaths Rules 1999 namely:-

1. (i) These rules may be called the Sikkim Registration of Births and Deaths( Amendments) Rules 2007.

(2) They shall be deemed to have come into force on the 1st day of January, 2007

 

2. In Sikkim Registration of Births and Deaths Rules, 1999

    (hereinafter referred to as the said rules) in Form No.1 of the Births Report:-

 

(1)   after serial number 6 and the entries relating thereto, the following shall be inserted namely:-

7. Address of the parents at the time of birth of child

8. Permanent Address of the parents

9. Remarks

(2) The existing serial numbers 7,8,9,10,11,12,13,14,15,16,17,18,19 and 20 shall be renumbered as 10,11,12,13,14,15,16,17,18,19,20,21,22 and 23 respectively.

 

3. In these said rules in Form No.5 of Birth Certificate, below the Column Nationality of Father/Mother”, the following shall be inserted namely :-

            “Address of the parents at the time of Birth of the child

            Permanent address of the parents

            Remarks”

4. In these said rules in Form No.7 of the Birth Register:-

     (1) after serial number 6 and the entries relating thereto, the following shall be inserted namely:-

            “7 Address of the parents at the time of birth of the child

            8 Permanent Address of the parents

            9 Remarks

(2) The existing serial number 7 shall be renumbered as serial number 10

 

5. In the said rules, in Form No.2 of Death Report Legal information:-

(1) after serial number 4 and the entries relating thereto, the following shall be inserted namely

            “4 a. Name of Mother 

(2)   The existing serial number 4 a shall be renumbered as serial number 4b

(3)   After serial number 5 and the entries relating thereto, the following shall be inserted, namely:-

“6 Permanent Address of the deceased.

7 Address of the deceased at the time of death

8 Remarks”

(4) The existing serial numbers 6,7,8,9,10,11,12,13,14,15,16 and 17 shall be renumbered as 9, 10,11, 12, 13, 14, 15,16,17,18,19 and 20 respectively.

 

6.         In the said rules in Form No. 6 of Deatyh Certificate, below the column”place of   

            Death”, the following shall be inserted, namely:-

            “ Permanent Address of the deceased

               Address of the deceased at the time of death;

               Remarks”

 

 

     

 

 

 

7. In the said rules, in Form No.8 of Death Register:-

(1) after serial number 5 and the entries relating thereto, the following shall be inserted namely:-

            “6 Permanent Address of the deceased:

NOTIFICATION

 

 

In exercise of the powers conferred by sub-section (2) of 20 of the Sikkim Anti-Drugs Act, 2006 (2 of 2006) and in supersession of Notification No.19/HCHS & FW dated 06.06.2007, the State Government hereby empowers the following officers  of the State Government to exercise the powers under the said section of the Act, namely:-

 

1.     All Superintendent of Police in-charge of Districts;

2.     All Sub- Divisionable Police Officers in-charge of the Sub-Divisional;

3.     Programme Officer and Assistant Programme Officer of the Drugs Cell, Health Care Human Services & Family Welfare Department so designated under sub-section(1) of section 4 of the Sikkim Anti Drugs Act, 2006 and

4.      All Inspectors in-charge of the respective Police Stations.

As per the guidelines laid down by the Hon’ble Supreme Court of India and in partial suppression of Notification No. 09/HCHS&FW dated 19/06/2004, the State Government is pleased to constitute Quality Assurance Committees(QACs) at the State and District levels to ensure that the standards for female and male sterilization as laid down by the Government of India are being followed in respect of preoperative measures, operational facilities and post operative follow-ups.

 

 

The composition of the STATE QAC will be as follows:

 

1. Principal Secretary, HCHS&FW Department           -           Chairman

2. Director(FW)                                                           -           Vice Chairperson

3. Additional Director(RCH)                                         -           Member Secretary

4. Consultant Gynaecologist, STNM Hospital               -           Member

5. Consultant Anaesthetist,STNM                                 -           Member

6. Consultant Surgeon,STNM                                       -           Member

7. Joint Director(Nursing)                                             -           Member

8.  Medical Superintendent, CRH Tadong                     -           Member

9. Deputy Director(RCH)                                             -           Member

10. Representative from legal cell                                  -           Member

 

 

The terms of reference for the State QAC are as follows:

 

·        The State QAC shall visit both public and private facilities providing family planning services in the state to ensure the implementation

·        Shall review and report deaths/complications following sterilization in the State.

·        Shall review and report cases of comception due to failiure of sterilization in the State.

·        Shall give directions on the implementation of measures for improving the quality of sterilization services in the State.

·        Shall review the implementation of the National Family Planning Insurance Scheme/payment of compensation in the State.

·        Shall meet once in every six months.

·        Aminimum of three members shall constitute the quorum.

 

The composition of each District QACs(DQACs) will be as follows:

1.      District Collector                            -           Charperson

2.      Chief Medical Officer                     -           Vice Chairman

3.      District Medical Superintendent       -           Member

4.      District RCH Officer                       -           Member Secretary

5.      Gynaecologist, District Hospital       -           Member

6.      Surgeon District Hospital                -           Member

7.      Anaesthetist, District Hospital          -           Member

8.      Assistant Nursing Superindent         -           Member

9.      Representative from the legal cell     -           Member

                       

                        The terms of reference for the District QAC are follows:

·         The District QAC shall conduct medical audit of all deaths related to sterilization and send reports to the State QAC office

·         Shall collect information on all hospitalization cases related to complications following sterilization failure.

·        Shall process all cases of failure, complications requiring hospitalization and deaths following sterilization for payment of compensation and will pursue these cases with the insurance company or otherwise.

·        Shall review all Static institutions i.e. Government and accredited private/ NGOs and selected camps providing sterilization services for quality of care as per the standards laid down and recommend remedial action for institution not adhering to the standards.

·        A minimum of three members shall constitute the quorum.

 

The order shall take immediate effect.

1.      To go through the entire DPR and advise the technical feedback

2.      The two blocks to be funded by the JICA should fall within the framework of the DPR.

3.      The Upgradation of STNM Hospital would be done in a phased manner and the necessary action to be taken immediately. The shifting of the redundant/condemned equipments as envisaged in the detail report submitted by The Joint Director,PME to be immediately taken up in order to create more space.

4.      How and the manner in which the shifting is to take place.

 

The Committee should submit its report within 30 days from the date of issue notification.

In exercise of the powers conferred by sub-section(i) of section 20 of the Sikkim Anti-Drugs Act, 2006(2 of 2006) and in supersession of Notification No. 18/HCHS & FW dated 06.06.2007, the State Government hereby empowers the following officers of the State Government to exercise the powers under the said section of the Act, namely:-

 

  1. All Districts Collectors/District Magistrates of the District;
  2. All Additional District Collector/Magistrates of the District and
  3. All Sub-Divisional Magistrates in-charge of the Sub-Division

Fifty Thousand) only for treatment outside the state. Further the unspent Medical Advance taken shall be adjusted from the Employees’ salary at source.

In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Sikkim is pleased to make the following rules further to amend the Sikkim Services( Medical Facilities) Rules, 1981, namely:-

 

Short title and 1.         (1) These rules may be called the “ Sikkim Services (Medical Facilities) Amendment

Commencement         Rules, 2007”:

 

                                    (2) They shall come into force on the date of publication in the Official Gazette.

 

2.             In the Sikkim Services( Medical Facilities) Rules, 1981, ( hereinafter referred to as the    

 Said rules), in rule 3,-

(1)     in sub-rule(2),-

(a)    after the words “minor brothers”, and before the words “children wholly dependent upon the Government servant”, the following shall be inserted, namely:-

      “Widowed sister, unemployed major brothers”;

(b)   in the existing explanation, for the words and figure Rs.500/-,the words and figure  

      Rs.2500 shall be substituted;

(2)     in sub-rule(5), for existing Note, the following shall be substituted namely:-

Note: The treatment shall include provision for prosthetics, hearing aids and spectacles.

 Provided that the spectacles shall be made under the prescription of an Ophthalmologist and the reimbursement in case of spectacles shall be limited to Rs. 2500/-, for hearing aids and prosthetics, the limit of reimbursement shall be Rs.4000/-

 

3.            In the said rules, in rule 7, after sub-rule(5) the following sub-rule shall be inserted     

namely:-

            “(6) Reimbursement of claim in respect of vaccines shall be allowed except for the   

             vaccines used for routine immunization of children.

           

            Provided that the vaccination has been prescribed bt the treating medical practitioner.”

 

4.      In the said rules, in sub-rule of rule 11, for the words and figures “Rs.500/- per day” shall be substituted.

5.      In the said rules, in sub rule(1) of rule 12,-

(1)     for the words and figures “Rs.10,000/-“ the words and figure “Rs.15,000/-” shall be substituted;

(2)     In the proviso, after clause (iv), the following clauses shall be inserted, namely:-

“ (v) All terminally ill cases as certified by the State Medical Board;

(vi) Patients who expire during during treatment:

(vii) Dialysis

(viii) Cirrhosis of Liver:

(ix) Gall Stones requiring laparotomy:

(x) Grievous gunshot injuries.”

                                   

6.      In the said rules, for the existing rule 15, the following shall be substituted, namely:-

“Treatment in a private hospital/nursing home shall be admissible if the required facility is

Not available at the time of emergency in the referred institute.

     

 

Provided that the Superintendent or the attending physician of the referred institute certifies to the effect under their seal and signature.”

 

2.      In the said rules, in rule 20,-

(1)in the sub-rule(1), after the words “ Director Health Services” and before the words “grant an advance”, the following words shall be inserted, namely:-

 

“ or Additional Director of Health Services as specially notified by the Health Department”,

(2) in sub-rule (3), for the words and figures “Rs.5000/- “ “ Rs.50,000/-( Rupees fifty thousand)”, shall be substituted;

 

(3) in sub-rule (5), for the words “ ten equal monthly installments” shall be substituted.

In supersession of Notification No.625/H&FW/94-95 dated 24.05.94 the Government of Sikkim has been pleased to review and sanction on outright one time grant of Rs.5000/- by Director Health Services as partial assistance for any illness to the members of the General Public for treatment of special cases referred by the Health Department. The claimant is required to give a declaration in the prescribed form meant for the purposes that he/she is not a regular employee or dependent under the Government of Sikkim.

           

            A maximum outright one time grant upto Rs.10,000/- as partial assistance maybe sanctioned by the Secretary Health on recommendation of the Medical Board for the following selected diseases:-

 

1.      Cancer

2.      Organ Transplant Surgery

3.      Bye Pass Surgery

4.      Selected neurosurgery cases

 

However, the Chief Minister and Minister Health may at their discretion in exceptional cases, sanction upto Rs.20,000/- and Rs.15,000/- respectively as one time grant.
